  • Short title and commencement
    1. (1) This Act may be cited as the Environmental Quality (Amendment) Act 2007. (2) This Act comes into operation on the date of its publication in the Gazette. Amendment of section 34B
    2. The Environmental Quality Act 1974 [Act 127], which is referred to as “the principal Act” in this Act, is amended in section 34B by substituting for subsection (4) the following subsection: "(4) Any person who contravenes this section shall be guilty of an offence and shall on conviction be punished with imprisonment for a term not exceeding five years and shall also be liable to a fine not exceeding five hundred thousand ringgit.".
    Amendment of section 43
    3. Section 43 of the principal Act is amended in subsection (1), by inserting after the words "director," the words "chief executive officer".
     
    New Requirement on Performance Monitoring of Industrial Air Pollution Control System
    Date: 08-08-2007 
  • Industries which are equipped with an Air Pollution Control Systems (APCS) are required to conduct performance monitoring activities to ensure that the APCS is being operated optimally and is in good working conditions. The industries are advised to refer to the guidance document issued by the Department of Environment entitled Technical Guidance Document Series No: DOE-APCS-5: Technical Guidance on Performance Monitoring of Air Pollution Control Systems for guidance on how to conduct performance monitoring of an APCS. The requirement on conducting performance monitoring of APCS has been made mandatory to all new cases of Written Permission (WP) by stipulating the requirement in the WP conditions of approval. Existing industries are also required to comply with this requirement no later than 31 December 2007.

  • The above Malaysian Standard on isokinetic sampling was issued by the Department of Standards in 2003 and several seminars have been conducted to publicize the standard to the industries and stack testing companies. The Department of Environment will only accept isokinetic sampling reports submitted by the industries which have been prepared in accordance with the above Malaysian Standard. Reports submitted which are not in accordance with the MS 1596:2006 will not be accepted and the industries will be required to reengage the stack testing companies to repeat the tests within two months of the date of the letter from DOE to the industries stating the unacceptance of the reports
